Why Do We Process Your Personal Data, and What Is the Legal Ground for Such Processing?
The services, which are provided by us either directly by our company or through our solution partners, including but not limited to the agents, call center, website, insurance brokers, banks and credit institutions, governmental agencies, adjusters, contracted repair shops, claims inquiry officers, such other 3rd parties, experts/surveyors, require processing of the personal and/or private personal data of the respective persons as part of the Law Nr. 5684 on Insurance Business, and the Turkish Commercial Code Nr. 6102, and the Law Nr. 5549 on Prevention of Laundering of Proceeds of Crime, and the Law Nr. 4358 on Generalization of Use of the Tax Identity Number, as well as such other laws and the secondary regulations as based on such laws, and also any and all national/international regulations and also the resolutions of any and all regulatory and supervisory authorities.
Such data may be obtained, recorded, maintained, stored, changed, reformulated, categorized, disclosed and transmitted to any 3rd parties by making use of automated or non-automated means as described under the "Law Nr. 6698 on Protection of Personal Data", or processed in any other manner whatsoever at the extent as permitted under the applicable regulations.
How Do We Collect Your Personal Data?
Any personal data may be processed for the purpose of performance and fulfillment of the requirements as prescribed under the respective contracts in respect of the insurance proposals and insurance policies, and also for provision of the insurance services, performance of the obligations as prescribed under the applicable regulations, determination of the identity of the person who/which performs the respective transaction and/or has such transaction performed, and issuance of records and documents, either electronically or in printed form, and also for fulfillment of the obligations with respect to information storage, reporting and provision of information as prescribed under the applicable regulations.
To Whom and For Which Purposes Do We Transmit Your Personal Data?
Your personal data may be transmitted to the regulatory and supervisory authorities, the relevant governmental entities, judicial and administrative authorities, professional organizations and such other organizations, and also to the persons or entities/organizations as permitted under the provisions prescribed under the Turkish Commercial Code, the Law on Insurance Business and such other regulations, and also to the financial institutions and such other third parties as listed under Section 31/A of the Law on Insurance Business, and also to the governmental and/or private legal entities such as the Undersecretariat of the Treasury of the Prime Ministry of the Republic of Turkey, and the CMB (Capital Markets Board of Turkey), and the MASAK (Financial Crimes Board of Turkey), and the Insurance Information Center, and the Insurance Association of Turkey, and also to the shareholders, agents, adjustors/surveyors, contracted services, banks, insurance brokers, domestic or international reinsurers and also to the persons and entities/organizations, from which we procure services or with which we collaborate for the purpose of performance of our operations as prescribed under the applicable regulations at the extent as permitted under the applicable regulations.
What Are Your Rights As Being the "Respective Person" Whose Personal Data Is Processed?
As part of Section 11 of the Law Nr. 6698 on Protection of Personal Data, you shall be granted with the rights, as listed herein below, upon applying to our company together with a document that would allow for determination of your identity without any hesitation thereto;
You shall be entitled to inquire whether your personal data has been processed, or not, and to ask for information regarding any such processed personal data, and to be informed about the purpose of processing of any such data, and also about the fact that whether such data has been used as appropriate to the purpose thereto, and to be informed about the third parties to which any such data has been transmitted, either domestically or internationally, and to ask for correction of any imperfect or inaccurate data, in case of any imperfect or inaccurate processing thereof, and to ask for *deletion/disposal of any such personal data in accordance with the terms and conditions prescribed under Section 7 of the Law, without any prejudice to the exceptional cases as listed under the said Law, and to ask for being informed about the transactions, which have been performed as per the sub-paragraphs (d) and (e) of Section 11 of the LPPD (the Law on Protection of Personal Data) with respect to the third parties to which any such personal data has been transmitted, and to raise an objection against such outcome in case of emergence of an outcome that is to the detriment of you upon the analysis of any such processed personal data solely by any automatic system, and also to claim for compensation of any and all damage and/or loss you might have incurred in case any such personal data has been processed in breach of the law.
(*) We shall be obliged to fulfill the statutory requirements with respect to retention of the documents with respect to the transactions executed by and between you and us. In case you ask for deletion or disposal of your personal data, then we may fulfill such request upon elapse of the period as determined as part of the statutory requirements. We shall remain entitled to ask for any and all costs and expenses, which might be incurred by our Company for the purpose of fulfillment of any request of yours hereunder, from you as based on the tariff as set out under Section 13 of the LPPD (the Law on Protection of Personal Data) with the heading "Application to the Data Controller".
